Drug charges leading to car forfeiture

My father's car was seized after I was

arrested driving it while in possession

of a controlled substance with intent

to deliver. We have filed paperwork

with the courts hoping to receive an

''innocent owner'' defense since he

did not know I was using the car and

it is not my car nor am I insured to

drive it. I want to know what

paperwork I should file to request a

court date to try and speak to a

judge about getting the car back. Is

there anyway to go about this?

Hello there,

You need to hire an attorney that does asset forfeiture work. There are not a lot of lawyers that do this but the work is not that difficult.

First, you should file a suit against whoever has your vehicle. This will begin with the original petition. If this has already been started by the State or Feds you need to file a general denial to their lawsuit.
