Legal Question in Criminal Law in Texas
drug possesion
my nephew and his girlfriend were recently arrested for a felony drug possesion the drugs were found in her purse . she is in a child custody case. So he thinks that he will just go to da and claim the drugs as his and then at her custody case she will be able to say she unknowingly or unintentionally was in possesion and be ok. This is crazy! They have already talked to some lawyer who is supposed to be a friend of hers and he told them that it would be a good idea to do this before she is indicted. This really smells! I'm not sure but I think drugs were probably hers anyway. I am just wondering what will happen to him if he goes up there saying that he put a half a gram of meth in her billfold in her purse without her knoledge??? I am pretty sure he has no idea what he is about to get into. Will it still be just drug possesion if he says he put into someone elses billfild?

Your nephew and his girlfriend need to contact lawyers. If they are unhappy with the law advice they are receiving from their current attorney, then they should seek a new lawyer. You should only hire a lawyer you are comfortable with.
