Legal Question in Criminal Law in Texas
DUI- 2nd offense
If the only evidence in the case is a video that the state seems to have lost what is the probability that the defendant will prevail? Also in the license suspension hearing, which they did no have enough evidence to convict beyond a preponderence of the evidence , the video seemed to be the key.

If the video is the only evidence, then there must be no testifying cop or breathalyzer or blood test results, and the defendant has a good chance of prevailing.
