Legal Question in Criminal Law in Texas
Dwi
Well i asked this befor ebut it looked like a third grader had wrote it sorry!
I was arrested on the 3rd of june for dwi. When i was pulled over the law officer asked for my drivers permit and insurance .I gave him the permit and told him i was going to havve to get out and get the insurance out of my bag.He told me to do so and to go to the back of the thr truck were he adminstered the road side test to me.I told the officer i was extremly pigion toed and the test would flunk me. I acted well i thought on the test as he stated to do.I new that when he asked me to step outta the truck i had no chance /i had been drinking but not to a limit were i felt impaired at all. From 7 at night till 11 at night and ther was several times i went outside to smoke with the girls no drinks allowed.
To my question: i was arrested for not taking the breath test i told the officer in texas that one beer would make it a positive test ther was not a fiar chance with the test.
So when we got situated in the car the oficer responded to a burglary in progress/he raced to the scene were ther already was five cars there.
The officer told me to hang tight and he would get me outta ther.Man i was scared to death
is this legal?
