Legal Question in Criminal Law in Texas
dwi and attorney
A friend of mine got a dwi when entering her neighborhood. She WAS at a bar, where her friend had just gotten a dwi while in the bar parking lot. It doesn't matter, but we feel she was followed and/or the other officer(s) made a call to have her picked up also. Due to the fact that she is the security director in her neighborhood, she knew one of the arresting officers that had arrested her friend. That officer handed her the keys to her friends car so she could get it home. She wasn't drunk, she passed the sobriety test no problem. She never said she wouldn't take the breathalizer, she just kept pleading with the arresting officer to let her go, or phone her husband (a few blocks away) or to let her call one of her constable friends (she named a lot of names, but din't say ''constable friends''). I don't think he liked that?! He arrested her, made her leave her purse, keys, phone, and coat (it was cold) in the front seat of her car and called a tow truck. She was taken downtown after going to the local constable precinct where she spent nearly 24 hrs. Bond had been posted with 2 or 3 hours, long before she was taken dt. She has hired an attorney,paid in full. He was late to court,and had white powder in his nose!What should she do?

I don't really know how to respond to this. She should interview several attorneys and seek counsel with one she feels she can trust. If she feels the attorney was using an illegal substance, that should be reported to the state bar and she should demand a refund of her retainer.
