Yes, the State Legislature passed a law that went into effect September 1, 2005, that changed the law where prosecutors can use prior convictions no matter how old they are. However, you need to be sure that your attorney knows what he or she is doing because not all convictions and or probations prior to 1984 are good and can be used to enhance the punishment. In other words, if your attorney does not do the research, a prior conviction that is bad can be used to increase the punishment when the court could rule that the prosecutor's can't use against you.
