Legal Question in Criminal Law in Texas

Early release for probation

I have served 8 years of a 10 year probation sentence. All requirements have been met. I would like to apply for early release, but I don't know how.

An attorney can file for early release of probation for you. Have you talked with your probation officer and asked him/her if they were opposed to early release? Their position carries a lot of weight with the judge.

Re: Early release for probation

Unless you are on probation for a sex crime or DWI, then all you need is a lawyer to draw up a motion for early termination and present it to the judge who sentenced you. The law recently changed, and judges are required to consider an early release after you complete half the term of probation. You're well beyond that. If you're legally eligible (again that only depends on the type of case you have), the only thing between you and freedom is the judge. He/She doesn't have to let you off early. Most criminal justice data would indicate that you are already a success. Most people will fail within the first 4 years if they are the type who just can't make probation work.
