You're stopped by police and eat drugs and still found with marijuana on you. You're charged with tampering with the evidence.

Based on what you have written, it appears that the alleged defendant is being charged with violating section 37.09 of the Texas Penal Code. Generally, the severity of the possession charge is based on the amount of the drugs. The tampering charge will carry more punishment as it is a 3rd degree felony (2 - 10 yrs in state jail with option fine up to $10,000).
