Legal Question in Criminal Law in Texas

My employers called yesterday to terminate me. They stated that I had been caught on camera stealing.

I have NOT stolen. It is a regular practice in my store for two years to take an item for delivery, be paid upon delivery and come back to put payment into the store. There for often I will be on camera walking out of the store with items not yet paid�.they are not searching or finding any times you can see me paying but in a very busy store that would be difficult to do. You could do an inventory but inventory system is usually off but I still feel that many items matched to the camera would show proper in the store.

Instead of just simply terminating me, they now want to press charges and have called all distributors to tell them NOT to work with me. They also have told all lesser management employee�s ( I am manager) of the issue and why I was fired�calling me a thief.

The Friday previously I had contacted our HR about an un-discussed pay cut in my paycheck and told her I was going to be contacting the state board the next Monday. I feel I am being retaliated upon. I did not steal but the video they are showing doesn�t look good�.and the inventory can be �fixed� if they so chose to go that far.

I feel that one reason they are going so far is that I am starting my own business of the same type on an area they have made clear they do not want to open in. However feel me a threat due to this knowing many customers will likely travel the hour to see me.

Get a lawyer. If they are talking about filing theft charges, you should consult with a criminal defense attorney and have him locate a bail bondsman for you. You need to be ready in case you are arrested. Get copies of any written evidence regarding this policy of taking unpaid items out of the store for delivery and collection on delivery. Be able to explain why a store manager would take items for delivery.

Get a lawyer to help you with your other claims. You should seek out an employment lawyer to assist you with your employment issues. It appears you may have some personal injury actions for defamation. If I am not mistaken, suit would have to be filed within a year for the defamation issues, so you need to see an attorney soon.
