Legal Question in Criminal Law in Texas
Evading Arrest
I looked up my record and noticed
that I have a warrant for evading
arrest. This is inaccurate. I think it
may of been my brother using my
name and drivers license. He was not
caught so they issued it under my
name. What course of action do I
have? If I go to the police would they
arrest him? What proof do they
need?

Hire a lawyer to file a Motion to Quash the Warrant, providing evidence of the mistaken identity.
If the initial evidence is not sufficiently compelling, the warrant will be served on you, and your lawyer will have to address the issue in negotiations or in trial.
