Legal Question in Criminal Law in Texas
what happens if my expensive lawyer passes away mid case & I paid in full up front?
they said i should get a partial refund...Yet it won't be enough to hire someone else to complete the case... (which is all I want)... it is scary to take a risk w a new lawyer & I cannot afford another penny..as I maxed out my credit card to pay for this chap...
1 Answer from Attorneys
You may be able to get some money back from the lawyer's office or from his estate, but even if you fired him, he would be entitled to at least a portion of his fee corresponding to the amount of work already performed on your case. You are entitled to your file, so you may be able to get that to assist any new lawyer you bring on to represent you. If you cannot afford a new attorney, then you may qualify for a court-appointed attorney, but you would have to prove that you meet the county's standard for indigence.
