Legal Question in Criminal Law in Texas

i was arrested 3 years a go for a class b theft iwas never charged i never went to court over the matter the owner of the building will not contest the matter they county atty. will not contest but the lawyer hired said that he can not do any thing on it right now because of a bill in legislation. the manager of the building said that i could have scrap to sell and when i went to get it i was arrested because they could not contact the manager. i am not a bad person i have gone to school to become a jailer and i can not go to work untill it is off my record what can i do to fix this problem and do you no of any thing that is in legislation about expongment?
