expunction and non disclosure

i requested a criminal record in regards to my background. i received probation for a felony 3rd degree after pleading guilty in 1976. upon completion 1yr later the judge dismiss all charges and restore all rights.. i believe i am elgible for a non disclosure..however upon my review of my criminal record and without any knowledge to me ,there was another criminal case listed on my background,.filed against me also in 1976 that was dismissed . it appears identical to the previous case.same court, same crime but with a diffrent cause no...it appears to be a mistake on the court clerks behalf and perhaps that is why it shows dismissed..i never was arrested,never notified,totally unaware about this incident until now. do i have to pay to get this remove from my criminal report, such as having it expunged or will the court be responsible.

You can further your research, and get a complete copy of both files, to determine if you believe you can resolve this problem on your own. An attorney will need complete copies anyway. If after reviewing the law, and your files, you are unable to resolve it, you will need to hire a lawyer. If you pled guilty, resulting in a conviction, you may not be able to get relief.
