Legal Question in Criminal Law in Texas
expunge record - dwi
Is there any way to expunge the record of someone who served probation for pleading guilty to DWI with an alcohol level of .092? This person's probation officer indicated that it was possible and that they would recommend it to the judge. The probation officer had indicated that he had seen it set it place up front before probation was served. If so, how would you go about doing it? Can it be done by the individual with a form or letter to the judge or would an attorney need to be obtained?
This person is a pilot and this history will show up each time he applies for a job and interferes with his ability to get a job. His record is otherwise clear except for speeding tickets.

Re: expunge record - dwi
The only way one can get a crime expunged from there record is if the charge was dismissed, they were found not guilty or if they successfully serve a period of deferred probation.
As far as expunging a DWI that one plead guilty to, you are not going to be able to have it expunged because you don't meet the criteria.
If my office can be of further service or if you have any questions feel free to call.
