Expungement of feleony
My future son-in-law was 18 when he was convicted of burglury of a habitat. He served 3 years in prison and has been off of parole for 1 year. No other problems. Can his record be expunged?

No. If he has a finding of guilt, he is not eligible for expunction. You may wish to contact the governor's office in Austin to obtain the forms to apply for a pardon, though.

Once convicted of a felony, your son is not eligible for expunction unless he first obtains a pardon from the governor. If he had deferred adjudication probation, I could help him get a nondisclosure order in time, but it does not appear that was the case, since he actually served time. It looks like a pardon is your only avenue in this case.
