Legal Question in Criminal Law in Texas
expungement or nondisclosure?
I am 18 and made a stupid decision to shoplift. I was arrested and charged with a Class B misdemeanor. I never actually saw the judge. Before my trial, my lawyer filed a motion to postpone it so I could do community service and attend a program. After I finished everything, they dismissed my case. I believe that I still have an arrest record, but I don't know how long I have to wait to have it expunged and how I would go about doing so. I am also looking for a job, and I wanted to know how to answer the question ''Have you ever been convicted of a crime?'' Does being charged with a crime the smae as being convicted. I don't think I ever pled guilty, but rather entered in on a plea bargain. Do you think I can petition for nondisclosure?

Re: expungement or nondisclosure?
You have many questions. An attorney can research your case and determine if you are entitled to expunction or an order of non-disclosure, and when. A charge is not a conviction, and it sounds as if you do not have a conviction. Since the details are vague, hire a lawyer to see if your record can be cleared.
