Legal Question in Criminal Law in Texas

expungement

If a person charge with a drug misdemeanor in 2005 and paid his fine. Now when he apply for a job , company do a background check it always appear on his record. How can he get information purge extracted from his record when he apply for a job. I know that the information will appear if he get stop by police or for certain jobs with the government. Is there a way he can purge the information himself? What necessary steps need to be taken? What is the filing process, form, who do he submit the form too, do he appear before a judge to sign off on the form and once the information has been submitted how long he will have to wait before applying for a job? I know that he can pay a layer file the paper but if he is unable to get a job he cannot pay the fee. If he was recently charge with another drug crime (defreed judication) do he have to wait until until recent charge is off his record before filing for expungmeent????

You are going to have difficulty doing this yourself. You can go to the law library and research the law on Petitions and Orders of NonDisclosure. You may not be eligible, based upon the charges and dispositions you have described.
