Legal Question in Criminal Law in Texas

expungement question

I had a Misdmr B (Theft) expunged from my record, I thought, last summer. When I went back to check at the county clerks office after some time, my record still existed. This because they were not listed as an agency that needed to comply with orders to exp my record. I told my attorney, and he filed an amndmnt for it and 1 more agency for a total of 5;originally 3. They are: police Dpt, County Attnys Office, County Court Office, County Sheriff Office, and DPS.These were finally done when I checked months later when I inquired about some of them at the courthouse, however, I also discovered that the DA Office has my records by mistakenly inquiring there instead of the County Attny's Office first. My first question regards something I was told at the DA office - Is it true that the DA office does not release this record to the public or agencies like DPS? Next question, seeing that my advocate is not competent enough to list all agencies relevant, is there a place he should've looked that indicates what agencies received all this information? insult to injury, he was ordered to re-write the documents the morning of the hearing, because the judge said he wrote them up wrong.who else can have my records?how do i truly exp for good?

Re: expungement question

I can sense and understand your frustration, but I wouldn't blame your attorney. In the age of technology, it is difficult to know where your file has been shared. The DA should no longer have a file on you if has been expunged, so that should be a non-issue. You will have to physically retrace the steps of your file to see who has 'touched' it, and include that agency in the order. Even then, there may be invisible fingerprints on it. Do several online background checks on yourself, and see if anything comes up.
