Legal Question in Criminal Law in Texas
Expungment
In 2001 I was charged with a class b misdemenor for harassment.I was given 2yrs deferred and released after 1 yr.I had been told that after a certain period of time that you can ask for expungment of your record.I would like to know if the charge i had can be and what steps i need to take to do this.any information you can give me will be appericiated.

I am sorry if you were told that, you cannot have the offense expunged from your record. However, you can file a "Petition for Non-Disclosure" and have the record sealed from most of the public with the exception of some 23 public agencies including law enforcement, such disclosure would keep most employers, landlords, john Q public and your next door neighbor from being able to locate the offense. The Petition has to be filed in the court where you received the punishment. Naturally, my advice would be to hire an attorney to handle this for you. Good luck.

Dear Chadwick, you were told wrong! No expugement is available for your Harrassment charge. You can, however, seal your record by way of an Order of Non Disclosure. Please contact a local criminal defense attorney who can assist you with this matter.
