Legal Question in Criminal Law in Texas

Expungment of Records

You site basically states that there is no provision for expungment of criminal records...however there are several sites that claim it can be done.

I'm seeking information for a relative to find out how to expunge a 3 degree felonly for possession of a controlled substance. With intent to use not sell.

Re: Expungment of Records

Some prior convictions can be expunged under certain limited circumstances, such as when the defendant was entitled to be represented by a lawyer and wasn't. An informed guilty plea is difficult to prove under such circumstances, for example.

Some states have provisions for the expungement of low level drug convictions, and others for expungement of lesser crimes, again in certain circumstances.

If a site promises you they can expunge a drug conviction in TX, however, be sure you get solid proof before parting with any money. There are many claims on the net which will only make you poorer for having believed them.

Be careful. The elimination of a prior criminal conviction is seldom possible and then only under very limited circumstances.

If it was easy everyone would do it, wouldn't they?
