Legal Question in Criminal Law in Texas

Expuntion/acquitted

I had a Misd. Class ''A'' and ''C'' trial last year and I was acuitted from the case and now I wanted to get my record expunged. Do I have to wait for the limitation to be expired or I can go ahead and have my record expunged?

Hello there,

If you were found not guilty you can file motions to expunge the charges so they do not appear on your criminal record.

Sincerely,

You should be eligible immediately since the limitations period does not apply. That is, the State cannot prosecute you at any time in the future for these charges since they would be violating constitutional double jeopardy protections.

Bottom line is call a qualified criminal defense lawyer to investigate your rights to expunction. The lawyer can tell you best when you are eligible.
