Legal Question in Criminal Law in Texas

failure to ID

My 17 year old son was arrested for failure to ID. I need to know if he needs a lawyer, and what I should I expect as far as punishment. He has never been in trouble before.

Re: failure to ID

Failure to Id can be either a class b or class c misdemeanor depending on the circumstances. If a class c misdemeanor then facing a fine up to $500. If class B misdemeanor then up to 6 months in jail and a fine not to exceed $2,000. Often a person will get a better offer with a lawyer, then if they represent themselves. What you son wants is a deferred probation so that he will not have a conviction on his record.
