false asssult charge

son & friend confronted 3 others ,my son got hit by 1 of the others first. they fought ,my son won .the cops came, questioned the other 3,( not my son ) the other 3 said my son threw the 1st punch so my son was charged with assault & taken to jail. my son is also 17. is it legal for a 17 year old to be in an adult jail, and do we need an attorney to press charges on the other kid and to get out of the assault charge? my son plead not guilty.

You need to hire an attorney to represent your son. Assault is a class (A) misdemeanor and has a punishment range of up to a year in jail and a $4,000.00 fine or probation.

Just because he is falsely accused doesn't mean he is going to have the case dismissed. Cases are filed in every day due to false accusations and a 17 year old can be charged as an adult.

There have been people who are 17 years of age when they committed a crime that have been given the death penalty.

It is time to tell your son to grow up because there are consequences to his actions.
