falsely accused

If a man and a woman have and argument and the woman slaps the man, and the man puts up his arms to protect himself from any future attempts to slap him. Then the woman starts to become hysterical and trips and starts to fall and the man grabs her to keep her from hitting her head on bed.... Then two days later she files a report that the man hit her in the head. The man has two witnesses on his behalf... What should he do?????

You know, I was in court yesterday with a case not too much different than this one. Another lawyer had the case, I simply assisted in the voir dire and gave him comments on avenues to approach which I took from the witnesses. Slapping can cause bodily injury. Marks on the body are clear indications of physical force used on the body of another. If there is a dispute between the parties as to the reason for the physical force (tripping into the bed causing injury to head vs. being pushed into headboard or being hit on the head), then my friend, it is time to hire a lawyer and have money for a bondsman and have a number to call if you are arrested. Your lawyer will want to interview the witnesses and may choose to have them talk to the police, or not. Additionally, buy flowers.
