Legal Question in Criminal Law in Texas

family assualt

In November my husband and i got into an

argument,words were said and he threw a shew

towards me. It did not hit me but i hit my

head on the wall while leaving the room. The

police took him away even though i did not

want to press charges. Texas has a no drop

policy they stated. Yesterday i got in the

mail a letter from the district attorney with

some things to fill out. {victim information

sheet}. It states if we are unable to get in

touch with you the case against him can be

delayed or even dismissed. I really don't

want to proceed with this case. We get along

great and have a happy life, it was just a

big mistake. Do you think i can ignore this

and it might be dismissed or would it be

worse for him if i do???????

Contact an attorney about filing an affidavit of nonprosecution and/or an affidavit of nonoccurrence. Your physical presence is not necessary for the State to prove all of its elements against your spouse. However, the affidavits I spoke of may persuade a prosecutor to stop proceeding.
