My family member has a first degree felony case he is on. He been on the same case for 3. Years now I wanted to know how do we file a motion to dismiss

Your family member should have a lawyer representing him. That lawyer is the only one in the position to give your family member advice based on the information available to the lawyer. If your family member is not satisfied with the lawyer, the family member can hire another lawyer to substitute in and represent your family member.
