Legal Question in Criminal Law in Texas

family violence class c

me and my sister got into an argument after she was telling my daughter that i didn't love her. i was pushed into a wall, then my sister was provoking a fight. i didn't fight back instead i told her to leave. she was moving alot of heavy stuff out of the house because she was moving out. she tried coming back through the front door and i was blocking the way trying to keep her out. she called the cops and said i hurt her. by the time the cop showed up she had a scratch on her face and i don't know how that happened. egardless they were going to take me to jail because she pressed charges, they ended up giving me a ticket for family violence class c. what is going to happen to me when i go to court? i called the court house and they said i just had to pay the fine. is there any reason to believe i will be going to jail? thank you for your time.

No, you will not go to jail, BUT if you pay the fine, you will have an assault conviction. You may prefer to hire a lawyer to fight the charge.

Under the TX Penal Code, Class C Misdemeanors do not allow for confinement but have a maximum fine of $500. Please note that there may be the potential for enhanced punishments, which might include up to 180 days in jail, if there are aggravating factors. If my law firm can assist you with this legal matter or any other legal issue, please contact my legal assistant Jennifer ([email protected]).
