Legal Question in Criminal Law in Texas
Felony or not
My husband served 10 years for Arson he was released 4 years ago. He said he was a Felon, We hired a Lawyer to change his last name to his fathers and when the lawyer received his prison papers from Huntsville, tx the papers said he was convicted of a misdemeaner Arson no one was in the house it was abandoned. What do i do to find out if he is a felon or not? I also had the police officers I work with run his name and it came back as a felon 2nd degree I don't know any more.

Since the maximum time for a misdemeanor is 1 year in jail, and he served 10 years in prison, he is probably a felon. You should address these questions and concerns to the attorney you hired.
