Felony murder Indictment
If an individual is arrested for murder, how long can it take for them to be indicted. Is there a a time limit? The individual has been locked up since June 19, 2008 in Ector County. Thank you in advance for your response.

There is no statute of limitations for the offense of murder in Texas. Consequently, the State can take as long as they want to indict, subject to any constitutional speedy trial problems they might cause if they delay too long. Another issue, though, is bond. If the State does not indict within 90 days after arrest, the person may be entitled to a bond reduction. The criminal defense lawyer handling the case should know this and be prepared to file the appropriate motions.
