Legal Question in Criminal Law in Texas

Felony Prescription Fraud or Paranoid?

About two months ago I agreed to pick up one of Js prescriptions. The net day J claimed that he never authorized me to pick up his medication and that I did not give him his medication. J informed me that the pharmacy was going to prosecute me. Neither the pharmacy nor the police ever contacted me.

Tonight I heard through the grapevine that charges were going to be filed any day now / I would be arrested for prescription fraud. I am 40 y/o and never been in trouble with the law. How can I find out if charges have been filed, or if there are any pending against me? I live in TX.

Re: Felony Prescription Fraud or Paranoid?

I don't know what county you live in. But, you should contact your local DA's office and talk to the folks in the intake or grand jury section just to find out whether a case has been filed. DO NOT DISCUSS THE FACTS OF YOUR CASE WITH THESE PEOPLE!

Once the case has been filed, a warrant will more than likely be issued for your arrest. Best plan is to hire an attorney to turn you in and post bond at the same time. Sometimes, the attorney can prevent you from ever going through the jail.

If the case is filed, more than likely you will be charged with a State Jail Felony (range of punishment six months to two years). You need to hire an attorney. If you want to discuss your case with me, call me at 866.351.1900 or visit my website at www.DallasJustice.com. You can discuss your case with me or I can refer you to another competent criminal lawyer.
