Legal Question in Criminal Law in Texas
felony theft of a building
My son was arrested with 3 others for attempting to steal alcohol from a liquor store, threw a rock, grabbed and ran. He was caught at the scene and the others fled- police said if he coperated he would have it easier,so he confessed. They arrested the other boys, the charges were dismissed on one, the charges were dropped to a misdeameaner on the one who has a record, and the third rec'd 3 years defered adjuddication. My son is about to receive 3 years of deferred adjuication, he coperated, told the truth and has never been in trouble before. My attorney told me he would get the same as the least amount of time because of his first offense and because they would not have had anyone if my son had not coperated. Since then he says that is not going to happen, can you tell me why the one who told the truth and has never been in trouble is having this happen to him? How will a felony deferred adjudication affect him and is there a waiting period for a felony to be sealed. Is my sons outcome allabout not having enough money to defend him properly. We are 5000 dollars in this already.

It is hard to know from what you have written why your son is not getting the same deal as the defendant who was received 3 years deferred. Perhaps his lawyer is must now deal with a different prosecutor.
I don't know the answer to your question about sealing the record but suspect that you son's attorney has an idea.
