Legal Question in Criminal Law in Texas
getting firearm returned
i was arrested last week on deadly conduct when i was working on a firearm in my house and it accidently went off no one was hurt and noone's property was damaged and i am the one who called the police to report it just to be on the safe side. The officer said that since there were other people in the house he was charging me with deadly conduct (class a). I am planning on fighting this charge seeing how it was an accident (i mean why would i call the police if i thought i comitted a criminal act) and will be hiring a lawyer but would like to know what i need to do to get my firearm back in the meantime and if it is even possible.

Right now the firearm is evidence. However, once the case is disposed of your attorney can try to get the gun back from the police department.
