Forgery case that was no billed.
I was wondering what I can do about a forgery case that I filed against my ex-wife that was no billed.I strongly believe that it was due to favortism or something similar.She forged my name on a letter to surrender my insurance policy and then forged my name on the check that was for a little over $3300.00.It was thrown out when it went to grand jury.

Additionally, make an appointment with the ADA that presented the case to the Grand Jury. Sit down and ask him/her to guess why the Grand Jury no-billed the case. If there is new evidence, he/she may be willing to present again. In any event, ask what the strengths and weaknesses are in the case. This is not a time or place to argue with the ADA, but to find out from a legal standpoint how to improve your civil case.

Go hire a civil attorney and sue her, because the case was presented to a Grand Jury and was no-billled. If you were married to her or in the throws of a divorce, then you have no case. But, if the two of you were divorced, then your only option is to sue her. In fact under Texas law, you can file the civil suit yourself in Small Claims Court located at the nearest Justice of the Peace either where your ex lives or where the transaction took place, and sue her without having to hire an attorney. If she hires an attorney to defend herself, then you might want to consider hiring an attorney, because the opposing counsel will know procedural rules that can cause problems for you and the case. I do not do civil work, and this has become a civil matter. Good luck.
