Legal Question in Criminal Law in Texas
Forgery, embezzlement or misuse of fiduciary funds
My mother passed away without a will leaving behind a family estate, her seperate real property. My stepfather knowingly signed her name to family estate oil checks after her death, cashing them for personal use. In addition he filled out her life insurance assisgnment of benificiary information and sent it in after her death and received her life insurance. Is this punishable by law? He is now fighting to receive his 1/3 life interest portion of her seperate real property estate, after sharing none of her community estate with the heirs. What are the childrens options?

Re: Forgery, embezzlement or misuse of fiduciary funds
I would start at your local police station.
All evidence of activity after the date/time of death should be gathered up and placed on the desk of the most senior investigator/detective.
