Legal Question in Criminal Law in Texas
Forgery retaliation due to breakup
My son recently broke up with his girlfriend and as a result she has become vindictive and vengeful. She had allowed my son to use her credit card for a few items and now claims that she did not give him permission to do so. She claims she is going to have him arrested for forgery. My son's roommate witnessed her giving him permission to use her card. My son has paid her back just to get her to stop harassing him. She continues to call and threaten him. She says it's not her, but the credit card people now who want to press charges. Can they press forgery charges on my son?

Re: Forgery retaliation due to breakup
No one can ever predict what a prosecutor
will or will not file, so it is entirely
possible that charges could be brough. This
does not mean that the prosecution would
be successful. I, as well as the prosecutors,
would be curious as to what name was signed.
Even if with permission, this could be
troublesome. Hence, the witnesses testimony
as to permission and the repayment are
essential.
