Legal Question in Criminal Law in Texas
My friend was arrested for fleeing from the police in a motor vehicle, the police officer was not on duty and was not in his police car. He was standing in the middle of the road with a flashlight in the middle of the night. Once the police officer got into his car and turned on his lights, he immediately pulled over. Is this still considered fleeing from the police? He has received a free lawyer and she has only met with him once and has not talked about his case with him, instead she told him what the D.A was offering, 10 years probation. Is there any way to prove he is not guilty of this crime?

He doesn't have to prove that he's not guilty. He is presumed innocent. The burden of proof is on the police.
He shouldn't take a plea bargain. He should demand a jury trial.
