Friend caught for Attempted theft
Hi,
My friend was caught trying to steal some shoes at Academy. She was walking out the first set of doors and it beeped, so she was asked to come back and when she did she ignored the guy and went back into the store and slipped the shoes off her feet and kicked them into the clothes. She then was taken by them to the back room where the police came. The policeman said she couldnt be charged with theft since she never left the premises so she got a citation for attempted theft. Now Academy is suing her for trying to the shoes. Can they do this since there was no damages to the shoes, and she never left the premises? They are wanting 300 dollars from her to avoid court. The shoes were only worth 107 dollars. I was wondering if they are just trying to get over on her, or is this something she needs to pay to avoid court....

Your friend must call a qualified criminal defense lawyer immediately to counsel her on the best course of action. Store owners often file civil suits for damages when a person is charged with theft. State law authorizes them to do so. Please have her contact an attorney right away to get help.
