Legal Question in Criminal Law in Texas
my friend stole a phone from a house, and was charged with burglary of habitation. i want to know what he could serve and what will happen to him. its his first time offence and it was not aggravated. he cooperated fully and they got the phone back.

If he is a first offender, he was probably charged with burglary of a habitation with intent to commit theft, first offender and is looking at up to 20 years in prison. As a first offender, and given the rather innocuous facts you have provided, there is a great chance that he will be offered deferred adjudication probation which means he will not be convicted of the offense (although he will have a criminal record for the rest of his life - even if he seals it in the future.)
