Legal Question in Criminal Law in Texas
My girlfriend is incarcirated in our local jail in gregg county, tx. She has been charged with POCS which is a class 3 Felony. She has been in jail for 6 mos. Can she qualify for a 1244A and who can request that for her? Her court appointed attorney refuses to do anything in her best interest. Thanks to anyone who can help.

Her attorney can't do anything because you have to be charged with a state jail felony to use 12.44(a). If the attorney could convince the prosecutor to reduce the charge to a state jail felony (based on the facts of the case), then it might be possible.
