Grand jury

My brother is going to grand jury. He witnessed a murder and is now called to grand jury what should he do.

Hello there,

Your brother needs an attorney to advise him of his rights before he goes before the grand jury.

First, I would want to know if he is a person of interest in the investigation or if they just want his testimony for the purpose of obtaining an indictment for someone else.

Second, he should understand that he as the right to remain silent and can not be held to answer questions that might incriminate himself.

Grand Jury's can end up being a kangaroo court where everything goes. The Grand Jurors can ask him questions and at some later date if his testimony is materially different from his former testimony he could be indicted for aggravated perjury.

One should always take these situations seriously.

Talk to a lawyer, If you can not afford an attorney the Court will appoint one to give him advice regarding wether or not he should testify and an attorney can be outside in the hallway to answer any questions he might want to ask his lawyer before he answers a question.

Once you have opened up your mouth you can't put the words back in.
