Legal Question in Criminal Law in Texas

Grand Jury Time Limit

I was arrested for a charge for forgery from 2002... but have never been indited for it. I made court appearance once this year but never saw the judge and was told to make sure my address/phone were correct and IF THEY EVER DID INDITE ME, they would notify me.

Isn't there a time limit of 3 years to indite this case?? Because it is almost 4 years since the charge was made and when I was arrested, none of the officers could tell me even what the charges were against me... the only word I can get from them is ''forgery''.. but it cost me $2900. to get out of jail... for what?? I am advised by a friend from the DA's office that this should be dropped now.

Re: Grand Jury Time Limit

SEE CODE OF CRIMINAL PROCEDURE ARTICLE 12.01 which states that felony indictments may be presented within these limits, and not afterward . . .under section(2)(C) ten years from the date of the commission of the offense: applies to forgery or the uttering, using or passing of forged instruments. Please note that the above is for offenses committed after the enactment of the current law. See subsection (E) if the offense was alleged to have been committed before Sept. 1, 2005, which had a three year statute of limitation for forgery.
