Legal Question in Criminal Law in Texas
Guilty by association
I have a brother who is 17 years of age and has been hanging with the wrong crowd. He has gotten involved with some type of burglary activity. This is his first offense he has never been in any other trouble. The detective contacted me offering him a deal if he will tell on the others involved and if some of the property is retrieved. I dont know if he should talk to the detective without legal representation because i am afraid if he does not give or have all the information the detective wants he may charge my brother with all of the cases. The detective states he is holding off on getting a warrant for my brothers arrest because he believes he can try to get him off without a case being filed to him. I do not trust this because i have no gaurantee that if my brother ups the information that he will not be charged. He is considered a adult and can go to prison since this is his first offense i wanted to see if he could just get off with community service and probation.

The detective may well be offering your brother a good deal, but doubt if either of you are in a position to analyze the validity of the deal. Hire a lawyer today. Call the detective, and say only that you need a day or two to discuss the matter further. Then let the attorney make the review all of the available information, talk with your brother, talk to the detective, and then give advice to your brother.
As a 17 year old first offender, he is probably looking at probation anyway. It would be nice, however, to avoid a felony conviction on his record, if possible.
