Writ of Habeas Corpus
There are many different types of writs called Habeas Corpus. They serve different purposes. There are state writs and federal writs. It is a good question, but rather vague for this technical group. You might address a group of weathermen and ask "Can we talk about rain?" In other words, why don't you post your specific question? Most individuals asking a question of this type are interested in what we call an 1107 writ, after Texas Code of Criminal Procedure, Section 11.07. The staff counsel for inmates in Huntsville handles many 11.07 writs, and there are "freeworld" lawyers who evaluate and prepare these types of writs. There is an evaluation stage which requires examination of the justice process for the individual. It pretty much is looking for an error made by the Judge which was fundamental to justice, missed by the Defense lawyer, missed by the appeal lawyer, made by the court of appeals, and of the type which the Court of Criminal Appeals in Austin or the Federal Court system might grant. (BTW, don't take a state habeas claim to Federal court yourself. Get a lawyer to do the habeas, as there are lots of traps and tricks.) A good book on 11.07 writs is the inmate legal handbook, published by the staff counsel for inmates in Huntsville and found in prison law libraries throughout the state.
