Legal Question in Criminal Law in Texas

I am being harassed by someone who lives in another state. This person has been sending me emails over the last few several months accusing me of things and calling me vulgars names. I have told her twice already to leave alone but she has not. She is married to my children's father , and apparently gets upset when he and I speak. I have only responded to 2 emails telling her to leave me alone. This person also works for the sheriff's department where she lives so she should know that what she is doing is wrong. Please help.

If it is possible, you should set up a block to prevent yourself from receiving the harassing communications. You should contact local law enforcement and provide copies of all the emails she has sent and your responses. She is violating the Texas harassment statute at a minimum, and may be violating federal law. Here is the relevant harassment statute:

� 42.07. HARASSMENT. (a) A person commits an offense if, with intent to harass, annoy, alarm, abuse, torment, or embarrass another, he:

(7) sends repeated electronic communications in a manner reasonably likely to harass, annoy, alarm, abuse, torment, embarrass, or offend another.

(b) In this section:

(1) "Electronic communication" means a transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic, photoelectronic, or photo-optical system. The term includes:

(A) a communication initiated by electronic mail, instant message, network call, or facsimile machine;

(2) "Family" and "household" have the meaning assigned by Chapter 71, Family Code.

(c) An offense under this section is a Class B misdemeanor, except that the offense is a Class A misdemeanor if the actor has previously been convicted under this section.

You might also contact her employer if she is a cop, and certainly whether she is a cop or not if she is sending the messages during work hours.
