Legal Question in Criminal Law in Texas

harassment charges

I filed criminal harassment charges against my husband who ive been separated from since 2007.There's a history of violence although I never filed a reportt but i do have witnesses. He's been making threats over the phone and in text messages. I need to get copies of both the calls & text messages from his cell phone company which is At&t because mine doesn't keep records. Is this possible? Also I need to know if I should tell him I done it or if i should wait until the detective calls him?

Re: harassment charges

Most cell phone providers will track the calls and the fact that a text message was sent, but they do not generally keep copies of the content of those calls or messages.

They also will not keep this info forever, although i couldn't tell you how long AT&T will hold on to the info.

Why should you contact him and tell him anything? What advantage does that provide you? I wouldn't tell him anything.

Also, the detective should be the one gathering this info, not you.

Re: harassment charges

You obviously cannot get records from someone else's phone. You need to inform the detective in charge of the case. He or she can subpoena the records.
