Legal Question in Criminal Law in Texas
when someone heavily under the influence of alcohol approaches you in your own home, and you're worried for your own safety as they're approaching you, and you've made it very clear that you want nothing but to get away from them, is it considered assault if you give them a black eye? or is that self defense?

It is considered an assault if the jury decides at trial that you are guilty beyond a reasonable doubt of assault.
