Legal Question in Criminal Law in Texas

Hot Checks

I received a bright orange post card from the County Attorneys office, in a county that I havent lived in for 9 years, stating that I have a balance of 900.00 due for bad checks written in 2000.

I moved from that area in 1999 but left behind a lot of stuff due to marital issues.

I moved several counties away and updated my drivers license to reflect my new address.

I was unaware of any checks written and I didnt write them but Im starting to think that my X wife did.

They claim theyve been looking for me even though I have had this same address on my license for 6 years and Ive been working, renting and have had a phone in my name.

They say theres not yet a warrant, they just want the funds.

Since theres not a warrant out for my arrest, does this mean that the statute of limitations has run out?

I have asked for copies of the checks to be faxed to me, clearly showing my signature and proof that my identification was shown when cashing the checks but I havent received them yet.

Re: Hot Checks

Hello there,

You need to hire yourself an attorney to go an look at this to see what they can do for you. There is the distinct possibility that the statute of limitations has already run and if so your case should be dismissed.

If you have any further questions feel free to contact me.

Sincerely,

Erick Platten
