Del Rio Madness
My name is David Sergi. I am an Austin area attorney who regularly practices in Del Rio state and federal courts. My practice is focused on border drug cases as I used to work as the Law Clerk for the Federal Judge in Laredoand learned the ins and outs of a drug case from the perspective of the Court before going into private practice.
In short, as you have figured out by now you have know entered what I call the border twilight zone.
The key issue in a detention hearing is what the government wants out of your husband and how may pre trial detainesthe Marshals service is overloaded with on a particular day. I do not mean to sound blase, however, they are so over loaded that, as you can tell, they can not even find your car, which is probably a critical piece of evidence in your husbands case.
In addition, the Magistrate is not going to do anything to offend the U.S. Attorneys office and grant bail if the Government opposes it.the Governmanet as she is the leading contender for the vacant U.S. Judgeship in Del Rio and she comes from the U.S. Attorneys office.
I would love to discuss the case with you, I am available on December 31 if needed. You can reach me at 512 392 5010 and tell the operator topass the call thru to my home or call my mobile at 512 627 1213.
I suspect that the car is at the Marshalls service impound lot in Del Rio( unless they consider this a major case in which case it is probably in San Antonio). As for your Xmas presents, they will be searched and most probably returned in the near future if you raise enough of a fuss.
Regardless of who you hire, there are many issues to address and I look forward to your call.
Houston Man jailed in Del Rio
Is the hearing on the 31st his first since his arrest? If so the US Magistrate will appoint either the Fed Public Defender or one of the attorneys on the appointment panel in the area..
Val Verde County has several Texas Criminal Defense Lawyers Assn. Members who can help you and who are familiar with the local court quirks. I haven't worked with any of them but if the went to the expense of TCDLA membership, they should be able to competently represent the defendant,They are:Victor Roberto Garcia 210-775-7466Richard Gutierez 774-5591Reginald Wade 775-0084The gentleman needs as good a lawyer as you can inform, he's looking at 27 to 87 months (depending on the weight and his criminal history) a large fine and some "supervised release".This is "Federal Time" there is no parole in the Federal system and good time seems to be awarded at about 1 day per month served.THIS COMMUNICATION IS NOT INTENDED TO CREATE NOR DOES IT CREAT ANY ATTORNEY CLIENT RELATIONSHIP, AND THIS RESPONSE IS BASED ONLY ON THE INFORMATION FURNISHED AND COULD VARY SIGNIFICANTLY FROM WHAT MIGHT BE RECOMMENDED AFTER A FULL INVESTIGATION.
