Legal Question in Criminal Law in Texas
what to do now????????
My husband was arrested last Thurs. for an 18 yr. old warrant, POM. Prior to this he was wrongfully arrested for no insurance. Had ins. & attorney took care of it. Thats all he has on his record. I happened to come across his papers from the bail bondsman tonight and noticed he has to appear in court tomorrow @ 8am. We havent contacted a lawyermainly short on funds also when he was arrested the police dept added two felony charges. Which were later dropped due to the affidavit not being turned in on time? My husband wasnt aware that the two new charges were dropped when someone came and spoke to him about a PR bond. So when he was asked if he wanted a court appointed attorney he said no. if he had known it was just for the POM warrant he wouldve said yes. My thoughts and question(s) are these can we somehow without a lawyer get this dropped or postponed to a later date so we can get a lawyer. Being the warrant is 18 yrs old Im wondering if the arresting officer at the time will even show up in court now to testify. We are nervous about walking into court tomorrow w/out an attorney.I need some advice from someone who is experienced and would point us in the right directionnot something you would call mom for right now.LOL

If you are still there, your husband needs a continuance to hire a lawyer. Most courts will give him at least 30 days. If he has been in the state during this time, this warrant can get quashed based on the circumstances you have described.
