Legal Question in Criminal Law in Texas
My husband was in a car accident that no one witnessed. He later received a notice to appear in court for not wearing a seat belt (he was wearing one) and speeding. If no one saw the accident, what should his response in court be to fight the charge?

Not guilty. Now - about the speeding. While there is a speed limit on a road which is posted, if there is a reason that one must go slower - say rain - then even going the speed limit can be speeding. And, a one car accident is often seen as an indicator of speeding (although it could also be driver distraction - another moving violation.)
